UGC video rights: who owns the content and what to agree

UGC · 3 min read

One of the most common questions for both brands and creators: who owns the video after filming, and where can it be used? Clear agreements matter here for both sides. We explain the basic concepts in simple terms (this is a general overview, not legal advice).

What usage rights are

Usage rights define where, for how long and in which channels a brand can use the video: organic only or paid ads too, one platform or all of them, indefinitely or a set period. This is a separate question from the fact of paying for the video.

Who owns the video after filming

Usually a brand orders a video to use it in its own ads and channels, so it receives the corresponding usage rights. The exact scope of rights — what precisely is allowed — should be agreed within the order before work begins. Then neither side has misunderstandings.

What to agree upfront

  • channels — social media, paid ads, website, marketplaces;
  • term — indefinitely or a set period;
  • territory — one market or several;
  • whether the video can be edited — editing, captions, cut-downs;
  • whether to credit the creator — as the sides prefer.

These points fit naturally into a brief — how to do it is in the guide How to write a UGC video brief.

Why it matters for a brand

Clear rights protect you from a situation where you launch an ad and it turns out there was no agreement for it. By agreeing the terms in advance, you can calmly scale winning creatives.

Why it matters for a creator

Transparent terms are also about your safety: you know exactly what the payment covers and how your work will be used. It is a normal part of professional collaboration, not a "detail".

How a platform simplifies the rights question

When the work goes through a platform, the terms of the collaboration are recorded in the system and payment is secure. That lowers the risk of "verbal deals" for both sides. More in How a UGC platform works.
